How Much Does Probate Cost?
Probate proceedings in California are very expensive.
For starters, both the attorney handling the estate and the executor or administrator are entitled to collect fees based upon the gross value of the estate by use of the following schedule:
4 percent of first $100,000
3 percent of next $100,000
2 percent of next $800,000
1 percent of next $9,000,000
0.5 percent of next $15,000,000
"Reasonable amount" above $25,000,000
Although the attorney and/or executor could charge less than these amounts, hardly anyone does. Moreover, attorneys can petition the Court for an award of additional fees.
There are also filing fees and costs to be paid. In general, a probate proceeding will cost around $2,000 or so in filing fees and costs.
